  1. Acceptable Use Policy

  1. Consent to Communications

5.1 Consent to Receiving Emails, Auto-Dialing, Auto-Texting, and AI-Generated Communications

By registering on the Site, submitting a contact form, or otherwise providing your contact information, you agree to have your information shared with O’Neil Property Group and our affiliated real estate professionals and service providers, and for us to initiate contact with you at the telephone number you provided using live, recorded, artificial, or AI-generated voice, mobile phone (including through automated dialing, text SMS/MMS, or pre-recorded messaging), and/or email, even if your telephone number is on a corporate, state, or the National Do Not Call Registry. You further represent that you have the authority to provide this consent regarding voice and text calls to the telephone number you provided.

By clicking any “Submit,” “Sign Up,” “Register,” or similar button on the Site, you expressly consent to these communication methods and agree to the terms of this policy.

5.2 SMS/Text Messaging Terms

We use SMS to confirm appointments, send reminders, deliver property alerts, and notify clients of schedule updates or important changes. The following terms apply to SMS/text messaging services:

You can cancel the SMS service at any time by texting “STOP.” After you send “STOP,” we will send a confirmation that you have been unsubscribed. You will no longer receive SMS messages from us unless you re-enroll.
If you are experiencing issues with the messaging program, you can reply with the keyword “HELP” for more assistance, or contact us directly at the contact information provided below.
Carriers are not liable for delayed or undelivered messages.
Message and data rates may apply for any messages sent to you from us and to us from you. Message frequency may vary. Contact your wireless provider with questions about your text or data plan.
Your opt-in data will not be sold or shared with third parties for promotional or marketing purposes.
5.3 Opting Out

To opt out of voice calls, tell the operator you no longer wish to receive voice calls. To opt out of text messages, reply “STOP.” To opt out of email communications, use the unsubscribe link included in any marketing email. Please note that you may still receive transactional or service-related communications even after opting out of marketing messages.

This license does not include the right to collect or use any product listings, descriptions, or prices; make any derivative use of the Site or its contents; download or copy account information for the benefit of a third party; or use any data mining, robots, or similar data gathering tools.

7.2 User-Generated Content

By submitting, posting, or displaying content on or through the Site, you grant O’Neil Property Group a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform such content in connection with the Site and our business operations. You represent and warrant that you own or have the necessary rights to grant this license.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED ONE HUNDRED DOLLARS ($100.00). THIS LIMITATION APPLIES REGARDLESS OF THE THEORY OF LIABILITY, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL OR EQUITABLE THEORY.

You agree to defend, indemnify, and hold harmless O’Neil Property Group, its Designated Managing Broker, agents, employees, licensors, and suppliers from and against any claims, actions, demands, liabilities, and settlements, including reasonable attorney’s fees, arising out of or related to your violation of these Terms, your use of the Site, any real estate decision you make based on information obtained from the Site, or your violation of any rights of a third party.

  1. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or your use of the Site shall be resolved exclusively in the state and federal courts located in Kendall County, Illinois, and you consent to the personal jurisdiction and venue of such courts.

14.1 Arbitration

At our sole discretion, we may require you to submit any disputes arising from these Terms or the use of the Site to final and binding arbitration under the rules of the American Arbitration Association, applying the laws of the State of Illinois. Any such arbitration shall be conducted in Kendall County, Illinois.

O’Neil Property Group is committed to compliance with all applicable fair housing laws, including the federal Fair Housing Act, the Illinois Human Rights Act, and all local fair housing ordinances. We do not discriminate on the basis of race, color, religion, sex, national origin, disability, familial status, sexual orientation, gender identity, ancestry, age, marital status, military status, order of protection status, or any other characteristic protected by applicable law.

  1. No Rights of Third Parties

These Terms and the policies incorporated herein do not create rights enforceable by third parties and do not require disclosure of any personal information relating to users of the Site.

  1. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions of these Terms shall remain in full force and effect.

  1. Waiver

The failure of O’Neil Property Group to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of O’Neil Property Group.

These Terms, together with our Privacy Policy and Accessibility Policy, and any additional terms to which you agree when using particular elements of the Site, constitute the entire agreement between you and O’Neil Property Group regarding the use of the Site, superseding any prior agreements relating to the same subject matter.
